This data policy (hereinafter – the Policy) on how personal data is processed applies to all information that the online molnija.shop, under the domain name molnija.shop, can receive about the User while he or she is using the website, programs and products of the online store.

1. DEFINITIONS

1.1. The following terms shall be used in this Policy:

1.1.1. “The administration of the online store (the “Website Administration”)” means authorized employees who manage the website, acting on behalf of molnija.shop, who organise and (or) carry out the processing of personal data, and also define the purpose of processing personal data, the type of personal data which shall be processed, and the actions (operations) which may be performed using personal data.

6. OBLIGATIONS OF THE PARTIES CONCERNED

6.1. The User shall be responsible for:

6.1.1. Providing information about personal data necessary for using the online store.

6.1.2. Updating and supplementing the information provided on personal data should there be any changes to this information.

6.2. Website Administration must:

6.2.1. Only use the information they have received for the purposes specified in paragraph 4 herein.

6.2.2. Protect the privacy of the personal information stored, not disclose information without having received prior written permission from the User to do so, and not sell, exchange, publish or disclose by making the User’s transferred personal data otherwise available, except as provided in subparagraphs 5.2. and 5.3. herein.

6.2.3. Take precautionary measures to protect the privacy of the User’s personal data in accordance with the established business practices for protecting such information.

6.2.4. Restrict the use of personal data related to the relevant User, should any false personal data or illegal actions be identified, from the moment an application is submitted or a request is made by the User, by his or her legal representative, or by an authorized body for the protection of the rights of data subjects for the investigation period.

7. LIABILITY OF THE PARTIES

7.1. Should the Website Administration fail to fulfil its obligations, it shall be held responsible for losses incurred by the User in connection with the misuse of personal data, in accordance with the legislation of the Russian Federation, except in the cases as provided for in subparagraphs 5.2., 5.3. and 7.2. herein.

7.2. If personal information is lost or disclosed, the Website Administration shall not be responsible for this confidential information in the following cases:

7.2.1. The information had already become publicly known before it was lost or disclosed.

7.2.2. The information had already been received from a third party before it was received by the Website Administration.

7.2.3. The information was disclosed having received consent to do so from the User.

8. SETTLEMENT OF DISPUTES

8.1. Before filing a court case for disputes which have emerged in the relationship between the User of the online store and the Website Administration, a claim must be submitted (a written suggestion for the voluntary settlement of the dispute).

8.2. The recipient of the claim shall notify the claimant in writing of the conclusion after the claim has been considered within 30 calendar days from the date of its receipt.

8.3. If no agreement is reached, the dispute will be referred to a court of justice in accordance with the current legislation of the Russian Federation.

8.4. This Privacy Policy and the relationship between the User and the Website Administration are governed by the current legislation of the Russian Federation.

9. ADDITIONAL TERMS

9.1. The Website Administration has the right to make changes to this Policy without receiving the User’s prior consent.

9.2. The new Policy comes into effect from the moment it is posted on the online store, unless otherwise provided by the new version of the Policy.

9.3. All suggestions or questions regarding this Policy should be submitted using the dialogue boxes on any page on the website.
