Privacy Policy of "MOLNIYA-TIME" LLC Regarding Personal Data Processing (Privacy Policy)

1. General Provisions

1.1. This Policy regarding the processing of personal data (hereinafter referred to as the "Policy") is prepared in accordance with paragraph 2 of part 1 of Article 18.1 of the Federal Law of the Russian Federation "On Personal Data" No. 152-FZ of July 27, 2006 (hereinafter referred to as the "Law") and defines the position of "Molniya-Time" LLC in the field of processing and protecting personal data (hereinafter referred to as personal data), regarding compliance with rights and freedoms, describes the specifics of collecting, storing, using, and transmitting personal data, the requirements for their protection, as well as information about the rights of individuals whose personal data is concerned.

1.2. Personal data means any information relating directly or indirectly to an identified or identifiable natural person (data subject).

1.3. Processing of personal data means any action (operation) or set of actions (operations) performed with personal data, using automation tools or without using such tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.

1.4. Personal data security means the protection of personal data from unauthorized and/or unauthorized access to them, destruction, alteration, blocking, copying, provision, distribution of personal data, as well as from other unauthorized actions regarding personal data.

1.5. The Policy applies to all actions related to the processing of personal data by "Molniya-Time" LLC, including on the website www.molnija.shop (hereinafter referred to as the "Site") and the Call Center, in the information systems of "Molniya-Time" LLC.

1.6. The use of the Site or the Call Center by the User also implies their unconditional agreement with the rules of the Policy and the conditions for the processing of personal data specified therein. If the User does not agree with the terms of this Policy, the User should refrain from using the Site and the Call Center.

1.7. This Policy applies to personal data obtained both before and after the entry into force of this Policy.

2. Legal Basis and Purposes of Personal Data Processing by "Molniya-Time" LLC

2.1. "Molniya-Time" LLC processes and ensures the security of personal data to fulfill the functions, powers, and obligations imposed on "Molniya-Time" LLC by the legislation of the Russian Federation, including but not limited to, in accordance with the Constitution of the Russian Federation, federal laws, in particular Federal Law No. 152-FZ of July 27, 2006 "On Personal Data," subordinate regulatory acts, other federal laws of the Russian Federation defining the cases and features of processing such personal data, guiding and methodological documents, as well as the Civil Code of the Russian Federation, the Tax Code of the Russian Federation, Federal Law No. 2300-1 of February 7, 1992 "On Consumer Protection," Federal Law No. 402-FZ of December 6, 2011 "On Accounting," as well as the Charter and local regulations of "Molniya-Time" LLC.

2.2. "Molniya-Time" LLC is the operator of personal data in accordance with the Law.

2.3. The subjects of personal data processed by "Molniya-Time" LLC including through the Website and the employees of the Call Center, include, among others, users of the Website, buyers, and recipients of Goods (if the buyer has indicated another person as the recipient of the Goods), any other individuals who address "Molniya-Time" LLC with statements/requests, and employees of "Molniya-Time" LLC.

2.4. "Molniya-Time" LLC processes the personal data of the subjects of personal data for the following purposes:

• For the implementation of the entrepreneurial activities of "Molniya-Time" LLC in the field of e-commerce as the owner of the website (Online Store) and by independently selling goods (providing services) remotely, including through the Internet; provision of related logistics services (organization of product delivery and warehouse operations), as well as other ordinary economic activities as a legal entity, including self-promotion, quality control of the use of its services and services by third parties, organization of access control and on-site security for visitors, interaction with data subjects, counterparties, and third parties, in accordance with the current legislation of the Russian Federation, the Company's Charter, internal documents, and local regulations of the Company.
• For the conclusion, execution, and termination of contracts involving data subjects as parties, beneficiaries, or guarantors under such contracts, including, but not limited to, providing the opportunity to use the services and products of "Molniya-Time" LLC issuing prizes, and paying rewards as a result of contests and promotions, etc.
• To comply with and fulfill the requirements of the current legislation of the Russian Federation, including, but not limited to, accounting and tax accounting, organizing document circulation and archival storage, sending relevant information to state authorities, fulfilling the requirements and orders of state authorities, enforcing court decisions, considering claims of right holders and appeals of data subjects, etc.
• For the establishment and regulation of labor relations of the Company with data subjects and other relationships directly related to them, including for the performance of obligations and exercise of rights of the parties under employment contracts between them, including, but not limited to, calculation and payment of wages, sending data subjects on business trips, ensuring the security of data subjects, the Company, and third parties, controlling the quantity and quality of work performed and ensuring the safety of property of data subjects, the Company, and third parties, providing data subjects with various guarantees and benefits, etc.

3. Categories of personal data processed by "Molniya-Time" LLC

3.1. "Molniya-Time" LLC processes the following categories of personal data obtained from the respective categories of data subjects, in accordance with the purposes of personal data processing:

For the conclusion, execution, and termination of contracts involving personal data subjects as parties, beneficiaries, or agents under such contracts, including but not limited to providing the opportunity to use services and products of «Molniya-Time» LLC issuing prizes, making payments, receiving discounts based on the results of contests and promotions, etc.		- Parties, beneficiaries, or agents under contracts, including but not limited to users of the services and products of the Company, individuals providing services to the Company, participants in contests, promotions, etc.; - Users of the Company's website.

4. 3.2. The personal data mentioned in the sections of this section above may be obtained by "Molniya-Time" LLC through the following means:

• Provided by the data subject in person.
• Filling out relevant forms on the website.
• Sending correspondence or emails to the email addresses of "Molniya-Time" LLC.

3.3. "Molniya-Time" LLC may collect technical information when a user visits websites or uses mobile applications and services of the Company. This includes information such as IP address, type of mobile device used, device operating system and browser type, unique device identifier, referring website addresses, the path taken by the user through the websites and mobile applications of "Molniya-Time" LLC and so on. "Molniya-Time" LLC may also use technologies such as cookies, web beacons, and mobile device identifiers to collect information about the use of "Molniya-Time" LLC websites. Cookies allow "Molniya-Time" LLC to provide users with relevant information as they use the "Molniya-Time" LLC websites (e.g., opening and loading relevant pages). Web beacons allow tracking whether a specific page was visited, whether an email was opened, or whether advertising banners on "Molniya-Time" LLC websites and other sites were effective. "Molniya-Time" LLC uses this information to ensure the functionality of its websites and mobile applications, improve the quality of services provided, correct errors, and enhance the overall user experience. "Molniya-Time" LLC does not seek to identify specific users of its websites, mobile applications, and services.

4. Principles and Conditions of Personal Data Processing

4.1. When processing personal data, "Molniya-Time" LLC adheres to the following principles:

• Personal data processing is carried out on a lawful basis.
• Personal data are not disclosed to third parties and are not distributed without the consent of the personal data subject, except in cases provided for by Russian legislation.
• Specific lawful purposes are determined before the commencement of personal data processing (including collection).
• Combining databases, including databases containing personal data processed for incompatible purposes, is not allowed.
• Personal data processing is limited to achieving specific, predetermined, and lawful purposes.
• Processed personal data are subject to destruction or anonymization upon revocation of consent by the personal data subject, upon achievement of processing purposes, or in case of no longer needing to achieve these purposes, unless otherwise provided by federal law.
• The content and volume of processed personal data correspond to the stated purposes of processing. Processed personal data are not excessive in relation to the stated purposes of processing.
• Accuracy and sufficiency of personal data are ensured during processing, and personal data are kept up to date when necessary and relevant to the stated purposes of processing.
• Personal data are stored in a form that allows identifying the personal data subject for no longer than required by the purposes of personal data processing, unless the storage period for personal data is established by federal law, a contract, with the party benefiting from the contract, or the guarantor acting as the personal data subject.

4.2. "Molniya-Time" LLC does not process personal data related to racial or ethnic origin, political opinions, religious or philosophical beliefs, health status, personal life, membership in public associations, including professional unions. "Molniya-Time" LLC does not perform voice input and verification of personal data using unprotected data transmission channels. The transfer of data by personal data subjects to call center employees is voluntary and implies that the received data will be used in accordance with this Policy.

4.3. "Molniya-Time" LLC ensures the recording, systematization, accumulation, storage, clarification (updating, modification), retrieval of personal data using databases located within the territory of Russia, and does not carry out cross-border transfer of personal data.

4.4. The company has the right to entrust the processing of personal data to third parties - processors - based on contracts concluded with these parties. Such entities include service providers who assist the Company in its activities: hosting service providers, customer contact centers, courier services, etc. Processors undertake to comply with the principles and rules of personal data processing provided for by Federal Law No. 152-FZ "On Personal Data" (including Article 18.1 and Part 5 of Article 18), other laws, and subordinate acts. For each processor, the contract will specify:

• a list of processed personal data;
• the purposes of their processing;
• a list of actions (operations) that will be performed with the personal data by the processor;
• the processor's obligations to maintain confidentiality and ensure the security of personal data during their processing, as well as a list of measures taken by the processor to protect the processed personal data, including the requirement to notify the Company of incidents involving personal data;
• the obligation, upon the Company's request during the term of the assignment for the processing of personal data, to provide the Company with documents and other information confirming the measures taken and compliance for the purpose of fulfilling the Company's assignment requirements established by Federal Law No. 152-FZ.

The processor is not obliged to obtain the consent of the personal data subject for the processing of their personal data. If obtaining the consent of the personal data subject is necessary for the processing of personal data at the instruction of the Company, such consent is obtained directly by the Company.

In cases established by the legislation of the Russian Federation, the Company has the right to transfer personal data to third parties, including without instructing such parties to process personal data.

4.5. For the purpose of improving the quality of service for Users and Customers, statistical or other marketing and research purposes, "Molniya-Time" LLC develops, improves, optimizes, and implements new functionality of the Website. To ensure this, the User or Customer agrees and instructs "Molniya-Time" LLC to process (including collection, recording, systematization, accumulation, storage, clarification (updating, modification), comparison, extraction, use, depersonalization, blocking, deletion, and destruction) accounting and any other personal data of the User or Customer, including those available to the partner acting on behalf of "Molniya-Time" LLC, transferring the accounting and any other personal data of the User or Customer available to "Molniya-Time" LLC to partners for the purpose of executing such processing, and receiving from partners the results of processing analytical information, including the results of automated processing of such data, in the form of integer and/or textual values and identifiers.

4.6. "Molniya-Time" LLC has the right to transfer personal data to third parties with the consent of the data subject, as well as in cases where the possibility of transferring personal data to third parties is directly provided for by Russian legislation and does not require the consent of the data subject.

4.7. In order to comply with the requirements of the current legislation of the Russian Federation and contractual obligations, the processing of personal data by "Molniya-Time" LLC is carried out both with and without the use of automation tools. The set of processing operations includes collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transmission (provision, access), depersonalization, blocking, deletion, destruction of personal data.

4.8. "Molniya-Time" LLC does not make decisions that generate legal consequences for the data subject or otherwise affect their rights and legitimate interests based solely on automated processing of personal data.

4.9. "Molniya-Time" LLC does not verify and, as a rule, does not have the opportunity to verify the relevance and accuracy of the personal data provided by data subjects through the website. "Molniya-Time" LLC assumes that data subjects, acting reasonably and in good faith, provide accurate and sufficient personal data and keep it up to date.

5. Rights of Personal Data Subjects

5.1. The data subject, whose personal data is processed by "Molniya-Time" LLC, has the right to:

• at any time amend (update, supplement) the personal data provided by them by accessing their Personal Account in cases where the Site's functionality allows it;
• delete the personal data provided by them by sending a written notification to "Molniya-Time" LLC specifying the personal data that should be deleted;
• receive from "Molniya-Time" LLC:
• confirmation of the fact of processing personal data and information on the existence of personal data relating to the respective data subject;
• information about the legal grounds and purposes of processing personal data;
• information about the methods of processing personal data applied by "Molniya-Time" LLC;
• information about the name and location of "Molniya-Time" LLC;
• information about persons (except for employees of "Molniya-Time" LLC) who have access to personal data or to whom personal data may be disclosed based on a contract with "Molniya-Time" LLC or based on federal law;
• processed personal data relating to the data subject and information about the source of their receipt, unless otherwise provided by law for the provision of such personal data;
• information about the processing periods of personal data, including the periods of their storage;
• information about the procedure for the data subject to exercise the rights provided by the legislation on personal data;
• the name and address of the persons processing personal data on behalf of "Molniya-Time" LLC;
• other information provided by the Law;
• demand from "Molniya-Time" LLC clarification of their personal data, their blocking, or destruction in cases where personal data is incomplete, outdated, inaccurate, unlawfully obtained, or unnecessary for the stated processing purpose;
• withdraw their consent to the processing of personal data at any time by sending an electronic message with an electronic signature to the email addresses: web@molnija.shop , or by sending a written notification to the address of "Molniya-Time" LLC. Upon receipt of such a message, the processing of the personal data of the data subject will be terminated, and their personal data will be deleted, except in cases where processing can be continued in accordance with the legislation of the Russian Federation. In this case, the sending of such a message about withdrawing consent by the User and/or Buyer should also be considered as a notification of unilateral refusal to execute the corresponding Order, making it impossible to fulfill it;
• demand the elimination of unlawful actions of "Molniya-Time" LLC regarding their personal data;
• take measures provided by law to protect their rights and legitimate interests, including compensation for damages and/or compensation for moral harm in court.

5.2. The rights provided for in the subparagraphs of this Section above may be restricted in accordance with the requirements of Russian legislation and/or in cases where "Molniya-Time" LLC processes personal data on legal grounds other than the consent of the data subject.

6. Obligations of "Molniya-Time" LLC

6.1. In accordance with the requirements of the law, "Molniya-Time" LLC is obliged to:

6.1.1. Provide the data subject, upon request, with information regarding the processing of their personal data, or lawfully provide a refusal within ten days from the date of receiving the request from the data subject or their representative.

6.1.2. Upon the request of the data subject, clarify, block, or delete the processed personal data if the personal data are incomplete, outdated, inaccurate, unlawfully obtained, or unnecessary for the stated purpose of processing, within a period not exceeding seven working days from the date of providing the data subject or their representative with information confirming these facts.

6.1.3. Maintain a record of requests from data subjects, which must include requests from data subjects for obtaining personal data, as well as the facts of providing personal data in response to these requests.

6.1.4. Notify the data subject about the processing of personal data in cases where the personal data were not obtained from the data subject. Exceptions include the following cases:

• The data subject has been informed about the processing of their personal data by "Molniya-Time" LLC;
• The personal data were obtained by "Molniya-Time" LLC in connection with the performance of a contract, of which the data subject is a party, beneficiary, or guarantor, or based on the requirements of applicable legislation;
• The personal data have been made publicly available by the data subject or obtained from a publicly available source;
• "Molniya-Time" LLC processes depersonalized personal data for statistical or other research purposes, provided that the rights and legitimate interests of the data subject are not violated;
• Providing the data subject with information contained in the notification of personal data processing would violate the rights and legitimate interests of third parties.

6.1.5. Upon achieving the purpose of processing personal data, immediately cease processing the personal data and destroy the corresponding personal data within a period not exceeding thirty days from the date of achieving the purpose of processing the personal data, unless otherwise provided by the contract, of which the data subject is a party, beneficiary, or guarantor, or by another agreement between "Molniya-Time" LLC and the data subject, or if "Molniya-Time" LLC is not entitled to process personal data without the consent of the data subject on the grounds provided by the Law or other federal laws.

6.1.6. In case the data subject revokes their consent to the processing of their personal data, cease the processing of personal data and destroy the personal data within a period not exceeding thirty days from the date of receipt of the revocation, unless otherwise provided by an agreement between "Molniya-Time" LLC and the data subject. "Molniya-Time" LLC is obliged to inform the data subject about the destruction of personal data.

6.1.7. Upon receiving a request from the data subject to cease the processing of personal data obtained for the purpose of promoting goods, works, services on the market, immediately cease the processing of personal data.

6.1.8. When collecting personal data, including through the Internet, "Molniya-Time" LLC ensures recording, systematization, accumulation, storage, clarification (updating, modification), extraction of personal data of citizens of the Russian Federation using databases located in the territory of the Russian Federation.

7. Protection of Personal Data

7.1. When processing personal data, "Molniya-Time" LLC takes necessary legal, organizational, and technical measures to protect personal data from unauthorized or unlawful access, destruction, alteration, blocking, copying, provision, distribution, and any other unlawful actions concerning personal data.

7.2. These measures include, in particular:

• Appointment of a person responsible for organizing the processing of personal data and a person responsible for data security;
• Application of legal, organizational, and technical measures to ensure the security of personal data;
• Monitoring of measures taken to ensure the security of personal data and the level of security of information systems containing personal data;
• Assessment of the harm that may be caused to the subjects of personal data in case of violation of the requirements of personal data legislation, the proportionality of such harm to the measures taken by "Molniya-Time" LLC to ensure compliance with the obligations provided by personal data legislation;
• Compliance with conditions that prevent unauthorized access to physical media containing personal data and ensure the safety of personal data;
• Familiarization of employees of "Molniya-Time" LLC directly involved in the processing of personal data with the provisions of Russian legislation on personal data, including requirements for the protection of personal data, local regulations on the processing and protection of personal data, and training of employees of "Molniya-Time" LLC.

8. Processing (Storage) Period for Personal Data

8.1. The processing (storage) period of personal data is determined based on the purposes of processing the personal data, in accordance with the term of contracts with the subjects of personal data, and the requirements of the current legislation.

For the performance of a contract, where the data subject is a party to the contract, or a beneficiary or guarantor under the contract, as well as for entering into a contract at the initiative of the data subject or a contract under which the data subject will be a beneficiary or guarantor.	During the term of such agreement, except in cases where a longer period for processing personal data is established by the current legislation of the Russian Federation.
For the protection of life, health, or other vital interests of the data subject, where obtaining the data subject's consent is impossible.	Until the moment when obtaining consent from the data subject becomes possible, or when the relevant grounds endangering life, health, or other vital interests cease to exist (whichever occurs earlier).
For the exercise of the rights and legitimate interests of the data controller or third parties, provided that the rights and freedoms of the data subject are not violated.	Within the period necessary for exercising rights and ensuring legitimate interests. The specific period is determined by the Company in accordance with the provisions of this Policy, internal documents and local regulations of the Company, as well as the principles of personal data processing and the requirements of the current legislation of the Russian Federation, including the cessation of processing personal data upon achieving specific, predefined, and lawful purposes of such processing.

8.2. Personal data, the processing (storage) period of which has expired, must be destroyed, unless otherwise provided by the legislation of the Russian Federation. Storage of personal data after the cessation of their processing is allowed only after their anonymization.

9. Procedure for Obtaining Clarifications on Personal Data Processing

9.1. Individuals whose personal data is processed by "Molniya-Time" LLC may obtain clarifications regarding the processing of their personal data by contacting "Molniya-Time" LLC in person or by sending a written request to the address of "Molniya-Time" LLC.

10. Automatically Collected Information

10.1. "Molniya-Time" LLC may collect and process the following information, including information that is not personal data:

• Information about the interests of users on the Website based on the search queries entered by users of the Website about the products being implemented and offered for sale, for the purpose of providing up-to-date information to users when using the Website, as well as summarizing and analyzing information about which sections of the Website and products are in greatest demand among users of the Website;
• Information about the interests of users of the Call Center based on the inquiries received from users of the Call Center, for the purpose of providing up-to-date information to users when using the Call Center, as well as summarizing and analyzing information about which features of the Call Center are in greatest demand among users of the Call Center.

10.2. "Molniya-Time" LLC processes and stores search queries of Website Users for the purpose of summarizing and creating customer statistics on the usage of Website sections.

10.3. "Molniya-Time" LLC automatically receives certain types of information obtained during the interaction of Users with the Website, email correspondence, etc. This includes technologies and services such as web protocols, Cookies, Web beacons, as well as third-party applications and tools. However, Web beacons, Cookies, and other tracking technologies do not automatically collect personal data. Only when a Website User voluntarily provides their personal data, for example, when filling out a feedback form or sending an email, do processes for automatically collecting detailed information for the convenience of using websites and/or for improving interaction with users begin.

10.4. If "Molniya-Time" LLC can reasonably correlate the information provided in this section with the User Account of a specific User, such information may be processed together with Personal Data and other personal information of such User.

11. Changes to the Policy. Other Provisions

11.1.
